By using BabyHitchHikers, you agree to these Terms of Service. Please read them carefully before creating an account or making a booking.
1. About BabyHitchHikers
BabyHitchHikers is a marketplace platform connecting parents ("Parents") with independent hiking guides ("Guides"). We facilitate bookings and payments but do not employ Guides. Guides are independent contractors responsible for their own conduct, certifications, and equipment.
2. Eligibility
You must be at least 18 years old to create an account. By using the platform, you represent that you have the legal capacity to enter into a binding agreement. Parents are responsible for ensuring that child information provided is accurate and that they have authority to make bookings on behalf of the children listed.
3. Bookings & Payments
Bookings are confirmed upon payment via Stripe. The total amount shown at checkout is charged immediately. BabyHitchHikers collects payment on behalf of the Guide and disburses it after the hike is completed, minus a platform service fee. See our Cancellation Policy for refund rules.
4. Guide Responsibilities
Guides represent that they hold all required certifications (CPR, Wilderness First Aid), have passed background checks, and will conduct hikes safely and professionally. Guides must maintain valid $1M liability insurance coverage for each hike. Guides are responsible for assessing trail safety and weather conditions.
5. Parent Responsibilities
Parents are responsible for providing accurate information about their children, including age, health conditions, and any special needs. Parents must disclose any medical conditions that could affect trail safety. Parents acknowledge that outdoor activities carry inherent risk and agree to the Assumption of Risk below.
6. Assumption of Risk
Hiking and outdoor activities involve inherent risks including, but not limited to, uneven terrain, weather changes, wildlife, and physical exertion. By booking a hike, Parents voluntarily assume these risks. BabyHitchHikers and its Guides take every precaution to ensure safety, but cannot guarantee a risk-free experience.
7. Limitation of Liability
To the maximum extent permitted by law, BabyHitchHikers shall not be liable for any indirect, incidental, or consequential damages arising from use of the platform or any hike. Our total liability to you for any claim shall not exceed the amount paid for the booking in question.
8. Prohibited Conduct
You may not use the platform to book hikes for purposes other than those described, impersonate any person or entity, provide false information, or circumvent the platform by arranging payments directly with Guides outside the platform. Violation may result in account termination.
9. Changes to These Terms
We may update these Terms from time to time. We will notify registered users by email of material changes. Continued use of the platform after changes constitutes acceptance of the updated Terms.
